This Privacy Policy ("Privacy Policy") describes how Momos USA, Inc. (“Momos,” “we,”“us,” or “our”) collects, uses, shares, and otherwise processes individually identifiable data "Personal Information") that we collect through the Momos website and your use of our products and or services (“Sites”).


2. Momos As a service Provider

Momos customers are businesses in the restaurant industry (“Customers”) that use the Momos proprietary software-as-as-service platform to manage and grow their business through the platform’s content management, reputation management, digital marketing management, and data and analytics tools. In its role as a service provider, Momos may receive Personal Information regarding the patrons or consumers of Momos Customers (“Customer Data Subjects”). To the extent that you are a Customer Data Subject and Momos is receiving your Personal Information on behalf of its Customer, Momos processes this information only according to our Customer’s instructions and this Privacy Policy does not apply.

If you are a Customer Data Subject, we encourage you to review the Customer’s privacy policy to understand how your Personal Information may be used by that Customer. If you have questions about their privacy policies or want to exercise rights you may have under applicable laws, you should direct your inquiry directly to the relevant Customer.

3. What Personal Information of Yours do we collect?

We may generally collect the following categories of Personal Information in connection with
your use of the Momos Sites:
  • Unique Identifiable Information: Unique identifiable information such as first and last name, business email, telephone number, company name, job level, functional role, street address, internet protocol address (“IP Address”).
  • Internet or other Electronic Information:  Internet Protocol address (“IP Address”); unique device identifier (UDID); cookies and other data linked to a device; and data about usage of the Momos website and communications.

4. The Sources for Information We Collect

Momos Processes Your Personal Data to:
  • Information you provide directly to us. Personal Information is required to use certain Site features, for example, to request information online or to contact us.  We will collect Personal Information that you provide to us through these Site features, in addition to any Personal Information you directly share via communications to us.

  • Information from Third Parties. We obtain data about individuals from various third-party companies and public sources, and we may combine that data with Personal Information or other data we collect. This enhances our existing data about our users, improves our ability to contact you, and enhances our marketing capabilities.
  • Information from Automatically Collected Data. We may automatically collect the following information about you when you use the Momos Sites:

IP Addresses, Cookies, & Similar Tracking Technologies. When you use the Sites, we and our vendors use technologies such as cookies (i.e., small pieces of data stored on your device’s hard drive by your browser), web beacons, pixel tags, and similar technologies to automatically collect IP addresses assigned to the computers and other devices you use, your internet service provider, device ID number, approximate geographic location, browser type, the Sites and pages visited, websites you access before and after visiting the Sites, and data related to how and when you use the Sites (e.g., date and time stamps, clickstream data, and data about search terms and websites that direct you to the Sites). We may combine this data with other data (including Personal Information).

The Sites may use session or persistent cookies to collect and store data about your preferences and navigation to, from, and on our Sites. Session cookies are used to complete transactions and for other purposes such as counting visits to certain webpages. Session cookies are eliminated when you exit your browser. Persistent cookies may be stored on your computer by your browser. When you log in, persistent cookies tell us if you have visited the Sites before or if you are a new visitor. Most browsers automatically accept cookies. You can disable this function but disabling cookies may impact your use and enjoyment of the Sites.

DO NOT TRACK REQUESTS. DUE TO THE AUTOMATIC COLLECTION OF DATA USING COOKIES, WE DO NOT HONOR "DO NOT TRACK" REQUESTS AT THIS TIME.


Analytics. We may occasionally enable and implement various analytics tools, such as Google Analytics, which is an analytics tool provided by Google to collect and process Personal Information and other data consisting of certain telematics about your use of the Sites. Google sets and reads cookies to collect such data and your web browser will automatically send such data, which may include Personal Information, to Google. Google uses this data to provide us with reports that we use to improve the Sites’ structure and content. We may occasionally enable and implement additional add-on services to Google Analytics, such as Demographics and Interest Reporting. Demographics and Interest Reporting uses cookies to collect data about our Sites’ traffic by tracking users across websites and across time to provide us with analytics on our user base.

Online Behavioral Advertising. We may occasionally use advertising networks and services provided by third-party vendors. These services collect data about your interactions with the Sites and other websites across the internet and use such data to target personal content and advertisements for goods and services. The data collected may be associated with your Personal Information. The targeted content and advertisements may appear on the Sites and on other websites and may be sent to you via email. Advertising networks often gather data about consumers who view advertisements to make inferences about a consumer’s interests and preferences, which enables the delivery of advertisements directly targeted to the consumer’s specific interests. This practice is often referred to as “online behavioral advertising.”


For example, we may use Google Ads to serve ads on our behalf across the internet and on the Sites. Google uses cookies and similar technologies to collect data about your visits to the Sites and your interaction with our services to generate targeted advertisements to you on other websites that you visit across the internet. To opt out of remarketing advertising provided through Google, to customize your ad preferences, or to limit Google’s collection or use of such data, visit Google’s Safety Center and Google’s Ad Settings and follow Google’s personalized ad opt-out instructions. Opting out will not affect your use of the Sites.


To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, visit the National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may occasionally still see our ads.


Social Media. We are active on social media, including Facebook, Twitter, LinkedIn and Instagram (“Social Media”).  Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) on the Sites and our Social Media pages any comments or content that you post on Social Media pages. You agree to hold Momos and its affiliates harmless and without liability for the results of any and all content you post on Social Media. Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Notice. We encourage you to review those policies and terms.  The Sites may use advertising networks and services offered by Social Media to deliver advertising content. Use of these services requires Social Media to implement cookies or pixel tags to deliver ads to you while you access the Sites.

Videos; Embedded Content. The Sites may contain videos and embedded content provided by Momos or third parties, including visible content and/or feeds scripts embedded in the Sites’ code. Momos and such third parties may collect data about how you interact with such content. By watching the videos and interacting with such content, you agree to the collection and use of such data.

5. Information We Do not intend to collect

  • Sensitive Personal Information. There are certain categories of Personal Information that Momos does not collect. Sensitive Personal Information” is any data that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or that involves genetic or biometric data or data concerning health or sexual orientation. We do not collect or intend to collect any Sensitive Personal Information from you and ask that you please do not provide Sensitive Personal Information to us.  
  • Information on Children. We ask that minors (under the age of 18) do not submit any Personal Information to us or attempt to use the Sites under any circumstance. We do not knowingly collect information from children under 18 years of age or have any reasonable grounds for believing that children under the age of 18 are accessing or using Sites. If we learn that we have inadvertently collected Personal Information from a child under age 18, we will promptly delete that information. If you believe that we might have any information from a child under age 18, please contact us as set forth below.

6. How We Use Your Personal Information

Momos does not sell or rent Personal Information except as stated in this Privacy Policy and as permitted by applicable law. Momos may use and share Personal Information as described below.

  • Purpose Collected & Communication with You. We use and share Personal Information for the purpose for which it was collected. For example, if you contact us for Momos product information, we may use Personal Information to contact you and assist you with your request. We may use Personal Information to notify you of changes to the Sites (e.g., changes to our Terms of Use or this Notice).
  • Administration.  We use Personal Information for administrative purposes, such as managing your accounts, facilitating transactions, to inform our business strategies, and to understand the Sites’ demographics and user preferences.
  • Employees, Affiliates, and Professional Advisor.  We may share Personal Information with our employees and affiliates who have a need to know the information for our business purposes. We may share Personal Information with our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to us.
  • Management and Improvement of Sites.  We use Personal Information for management of the Sites, such as troubleshooting problems, improving the content and functionality of the Sites, statistical and other analyses of the Sites, and to customize the Sites to you and our users.
  • Vendors, & Other Partners. We may share Personal Information with our third-party vendors, service providers, consultants, agents, and other partners (including management and hosting of the Sites, marketing and public relations, identity verification, and email services) that provide data processing services to us (e.g., to support the delivery of, provide functionality on, or help to enhance the security of the Sites) or otherwise process Personal Information for purposes described in this Notice or communicated to you when we collect such data. The parties described in this paragraph are authorized and may use and disclose Personal Information as needed to provide the applicable services to us.
  • Aggregated Data. We may use Personal Information to create anonymous, aggregated data. We may use and share such aggregate data with our affiliates, vendors, and other third parties to: (1) analyze, develop, and improve the content and services that we make available, (2) inform business strategies, (3) understand the Site’s demographics and user preferences, (4) customize promotional emails and users’ experience, and (5) for other lawful purposes.
  • Security & Protection of Rights. Momos may use your Personal Information by tracking use of our Sites to diagnose technical problems, as well as to prevent, detect, mitigate, and investigate potential security issues, as well as fraudulent or illegal activity. We may also use Personal Information and share it with third parties if we believe it is needed to operate the Sites or to protect our rights or the rights of others, including sharing data needed to identify, contact, or bring legal action if our contracts, terms, or policies are violated or if required by law.
  • Business Transactions. All Personal Information is exclusively our property. If we undergo a change or contemplated change in control, acquisition, merger, reorganization, or asset sale, all Personal Information may be transferred, sold, shared, or otherwise shared with potential and actual successors, which will be bound by this Notice as it applies to Personal Information.
  • With Your Consent. With your consent, we may use or share Personal Information in ways not specifically described in this Notice.

7. How Secure is my Personal Information?

We use commercially reasonable technical and organizational measures to help secure Personal Information from loss, misuse, alteration, or unintentional destruction. While we use industry standard protections to safeguard against such occurrences, no security measure can guarantee against compromise. If a breach of our Sites occurs, we will notify you of the breach only if and as required under applicable law.

YOU UNDERSTAND THAT NO DATA TRANSMITTION OVER THE INTERNET CAN BE GUARANTEED TO BE 100% SECURE. WHILE WE STRIVE TO PROTECT YOUR PERSONAL INFORMATION, WE DO NOT GUARANTEE THE SECURITY OF PERSONAL INFORMATION. YOU PROVIDE PERSONAL INFORMATION AT YOUR OWN RISK.

8. How Will we Handle any Changes to This Privacy Policy?  

We may update this Notice from time to time. If we make updates to this Notice, we will notify you by revising the date at the top of this Notice. All changes will be effective immediately upon posting to our Sites. Material changes will be conspicuously posted on the Sites or otherwise communicated to you.

9. Access from Outside the United States

This Privacy Policy is intended solely for a United States audience. If you access Momos Sites from Singapore please consult the Privacy Policy located here, or from Australia, please consult the Privacy Policy located here.
